MILTON — Carmen Reynolds has 60 days to find a civil rights attorney to handle her lawsuit against the state of Florida.
Santa Rosa County Circuit Judge Ron Swanson on Thursday granted the continuance and denied the state’s motion to dismiss the case.
Reynolds has named Gov. Charlie Crist, Attorney General Bill McCollum and Florida Surgeon General Ana Viamonte as defendants in her complaint that challenges a section in a new statute that allows law enforcement officers to vaccinate a resident in an emergency situation.
The statute says a resident can be forced to be vaccinated, treated or examined if they signify mortality and present a severe danger to the public.
Reynolds, a retired Air Force lieutenant colonel who has health issues herself, said the statute infringes on her constitutional rights.
“I have health issues, and with this statute in place, that is not a good thing. This goes against our rights at life, liberty, and the pursuit of happiness,” Reynolds said.

ReplyDeleteCan't think of the exact phrase but something like those rights not afforded to the federal gov't revert to the state. You might have to go after the Feds.

An uninformed public without adequate compensation for damages, loss of property, life, liberty, or the pursuit of happiness required under the U.S. Constitution is not really acting with choice.
ReplyDeleteIn context of the U.S. Constitution, the health and natural immunological adequacy of the human body represents private property and is not to be taken or compromised for "public use" without just compensation.
Our immune systems and our bodies are our sovereign properties according to Supreme Court decisions, the U.S. Constitution, and international law.
Presently there is no form of compensation for the property loss of natural immune system function and injury may result from this live virus (swine-flu) vaccination program. Therefore, such action a mandatory vaccination, compromising or utilizing by intoxication a person's immune system to allegedly protect the "public health" is illegal according to the U.S. Constitution.
